Patents Procedures

•  Once the application is published, it enters the Opposition Period. Oppositions may be filed within thirty (30) working days from the publication date.

• If an opposition has been filed, the Patent Office will inform the applicant and provide  him with a copy of the opposition. The applicant will have an opportunity to argue against the opposition within a thirty (30) period.

• If no opposition is recorded, the application will proceed for a substantial examination. The patent office will ensure that the application does not fall into any of the prohibitions for registration. If it does, the Patent Office will issue an Official Action. There is a sixty (60) day term to reply to the official action. If the Patent Office finds the application complies with our legislation, it will issue a resolution indicating the granting of the Patent.

• The estimated time for obtaining an Industrial Design - during a normal procedure - is approximately four (4) years.
