PCT Patents Procedures
- Once recorded the application, a formal examination is made to the application. If we submit all the documents with the application, the patent will be published within the next six to twelve months. Otherwise, an official action will be issued requesting the missing documents or information. We have two months to reply the Official Action.
- Opposition may be filed within thirty (30) working days from the publication date.
If any opposition has been filed, the patent office will inform the applicant about the opposition and provide a copy of it. The applicant will have an opportunity to controvert the opposing arguments within a thirty (30) day term.
- After publication we must request the substantial examination of the patent by the payment of the official taxes.
- If no opposition was recorded and the payment for examination is fulfilled the application will proceed for the substantial examination. The patent office will ensure tat the application does not fall into any of the prohibitions for registration, otherwise an official action will be issued. During a term of sixty (60) days the official action must be replied. If they found that the application complies with our legislation, the patent office will issue a resolution indicating their decision.
- The estimate time to obtain a patent registered during a normal procedure is approximately four (4) years.
