Trademarks Procedures
- As soon as the application is recorded including all the requirements, the trademark will be published for opposition purposes. No substantial examination takes place at this time.
- If the application is filed without the POA, the trademark office will issue and official action requesting the presentation of the document during the newt two months.
- Oppositions may be filed within thirty (30) working days from the publication date, where the opponent must provide the arguments and evidence supporting the reasons why the registration should not be granted.
- If any opposition has been filed, the trademark office will inform the applicant about the opposition and provide a copy of it. The applicant will have the opportunity to controvert the opposing arguments within a thirty (30) day term.
- After the opposition term is over, the trademark office will proceed with examining the registrability of the mark. This is the stage when the trademark office must ensure that the trademark application does not fall into any of the prohibitions to registration. The trademark office will issue the respective decision by means of a resolution served to the applicant and to the third party. Resolutions may be appealed during the next five (5) days from the notification of the resolution.
- If oppositions are not filed within thirty (30) working days from the publication date, the trademark office will proceed with the substantial examination to ensure that the trademark application does not fall into any of the prohibitions to registration. The respective resolution will be issued and notified to the applicant. Trademarks are granted for ten (10) years.
- The estimate time to obtain a trademark registration during a normal procedure is approximately fourteen (14) months.
